Civil Suits — Injunctions & Recovery
We file and defend a broad range of civil suits before the District Court – including suits for injunctions to restrain threatened or continuing wrongs, specific performance of contracts, declaration of title, and recovery of possession.
Our pleadings are drafted to anticipate every likely objection, and our evidence strategy is designed to ensure that oral testimony and documentary proof work together cohesively. We also handle urgent applications for temporary injunctions where time-sensitive protection of rights is required.
Probate & Succession
Succession matters require careful navigation of both substantive law and procedural formalities. We assist executors, legal heirs, and beneficiaries in obtaining probate of wills, letters of administration, and succession certificates from the District Court – enabling them to claim assets, manage estates, and resolve inheritance disputes with legal authority.
Where wills are contested or heirs are in dispute, we represent clients in contested succession proceedings with a thorough understanding of both testamentary and intestate succession law.
Money Recovery Suits
We file and pursue money recovery suits on behalf of individuals and businesses seeking to recover unpaid dues, loans, advances, and commercial debts through the District Court.
Where eligible, we invoke the summary suit procedure under Order XXXVII of the CPC — enabling faster relief without a full trial unless the defendant establishes a triable issue. We also assist defendants in resisting unreasonable recovery claims, raising valid defences, and negotiating structured settlements to resolve disputes efficiently.
Cheque Bounce – NI Act S.138
Section 138 of the Negotiable Instruments Act is one of the most litigated provisions in Indian courts. We represent both complainants and accused in cheque dishonour cases before the Magistrate Court.
For complainants, we ensure strict compliance with the mandatory notice procedure, timely filing of complaints, and effective prosecution. For the accused, we raise valid technical and substantive defences, challenge the presumption under Section 139, and – where appropriate – negotiate compounding of the offence to achieve a mutually acceptable resolution.
